This Master’s programme focuses on environmental law in transboundary contexts. Environmental law has become increasingly transboundary in character, as reflected in the development of EU and international environmental law on issues such as climate change and the protection of human health, watercourses, marine areas, nature and biodiversity – all matters that are part of this programme. The programme also considers the development of general notions and principles of environmental law and governance, and includes comparative elements. Moreover, it highlights crosscutting areas such as Environmental Law, Trade and Corporate Responsibility; Environmental Law, Climate and Energy; Environmental Law and Human Rights; and Environmental Law and Social-ecological Resilience.
The first half of the programme consists of two courses (ten weeks each): one in environmental law across state borders; and one with in-depth studies in the mentioned crosscutting areas. The forms of teaching in these two courses differ (classes, seminars, short essays and practical assignments, and teaching by external lecturers and experts), but the courses generally require active participation by the students. In the second half of the programme, while writing a master’s thesis, the students also participate in seminars and take part in a comprehensive mock-negotiation on a current environmental matter, where they learn how to apply practically their theoretical skills.
The purpose of the course is to give the students basic understanding of transboundary environmental law and related issues. This includes in particular international environmental law, but also existing supranational regimes (the EU) and transnational structures and methods (e.g. extraterritorial application of national laws) for handling and controlling environmental issues across state borders. As to the topics, the course embraces legal protection of human health, legal regulations and procedures air, water, soil, nature and biological diversity, and legal control of wastes and hazardous substances. The course also covers thematic issues such as dispute resolution, international institutions, environmental protection and globalisation, trade and the environment, responsibility of transnational corporations, environmental democracy, human rights and the environment, sanctions, implementation and the achievement of common objectives.
