The LL.M. programme focuses on the special situation of the region of South Eastern Europe and its approximation to the European Union, studying its legal past, present and future.

Austria was amongst the first countries to recognize this region’s potential, calling it the “region of the future”. Being held at the University of Graz, the Master programme takes place in the very heart of Europe. The special geographical position of this city to act as a gateway between South Eastern Europe and (Western) Europe, and to establish unique academic and economic relations with this region.

Our LL.M. programme follows this tradition that has proudly been maintained by the City and the University of Graz over centuries. The Master programme wants to bring together young graduates and members of the practicing legal professions, both from South Eastern Europe and from the member states of the European Union. Courses of the programme cover Community law and the various legal processes of European integration and approximation. In addition, participants gain a unique insight into the legal traditions and the legal culture of South Eastern Europe.

The aim of this Master programme is to offer a qualified training based on South East European law to graduates of legal or equivalent studies and to already practising members of the legal profession, both from Austria and from abroad. As regards the contents, the programme deals with the transformation processes within the respective countries and with the stabilization and association processes in the context of European integration. Questions concerning the structure of functioning democracies and the development of structures that are in conformity with the rule of law and with the free market economy will also be dealt with. The programme focuses on European law as well as on South East European countries’ private and public commercial law.

The duration of the Master programme is of three semesters, including the time needed to write the Master thesis and pass all the oral and written exams. In justified cases (e.g., professional reasons, illness), the duration of the programme can be extended to a maximum of three years.

In the first two semesters, five modules (Applicants can choose to register for either 5A or 5B. Availability depends on the number of participants.) must be attended. The duration of each module is of two weeks since the courses are held as intensive courses. In the third semester, participants are expected to write a master thesis. Participants must attend courses with 243 contact hours, and a total of 90 ECTS-credits are awarded for the whole Master programme (including the contact hours, self-study time and the Master thesis).


Contents

The programme is taught in five modules in the course of one year, thus representing the equivalent of one year of full-time studies. An additional semester is used for writing the master thesis. The course is vocational and may be extended up to three years.

Module 1: European Integration

Module 1 follows an interdisciplinary approach to the process of approximation of South East European countries to European structures (European Union, Council of Europe), but also to the world economic order. The participants should learn to use English as a technical language (course on "EU Legal English"). In addition, participants will be introduced to research approachesto the dynamics of integration (both from a historical and a political science point of view). Women and gender studies will also be considered. The first module should enable participants to understand the legal subjects that will be studied in their socio-scientific context.

The module consists of 45 contact hours and awards 12 ECTS-credits. All
courses are compulsory.

Module 2: EU Law & SEE

Module 2 aims at providing participants with fundamental knowledge on EU law.
The participants should study the European court system as well as the case law of the European courts of justice concerning the classic subjects of the Single European Market. The knowledge of the selected case law and of EU primary law, and especially of the four freedoms, should serve as a basis for understanding new legal problems that arise in the context of South Eastern Europe´s European integration. The module consists of 45 contact hours and awards 12 ECTS-credits. All courses are compulsory.

Module 3: Private Law & SEE

Module 3 studies the return of private law to those countries of South Eastern Europe that had been dominated by socialist legal thought for decades. Students should assess this movement in both its legal historic and cultural dimensions. In addition, participants will be enabled to evaluate tendenciesof unification in certain areas of private law, and to question the interaction of private law with the harmonisation initiatives of the European Union. The module consists of 45 contact hours and awards 12 ECTS-credits. All courses are compulsory.

Module 4: Business Law & SEE

In Module 4, those areas of private and public commercial law that are of central
importance for doing business in South Eastern Europe will be studied in more depth. The participants should learn to find cross-national solutions for recurring legal problems that arise when doing business, and they should also get to know "best practices" that were developed by legal practitioners.The module consists of 45 contact hours and awards 12 ECTS-credits. All courses are compulsory.

Module 5A: Public Administration in SEE

Module 5 A (compulsory optional courses) consists of five interconnected compulsory
optional courses. This module does not aim at merely conveying knowledge; instead, participants and lecturers should discuss current legal developments concerning the public administration in South Eastern Europe. Participantsshould be enabled to critically question their own national experiences and to develop scenarios for implementing European integration strategies. The module consists of 45 contact hours and awards 12 ECTS-credits.

Module 5B: Commercial and Corporate Law & SEE

Module 5 B also consists of interconnected compulsory optional courses. This module does not aim at merely conveying knowledge; instead, participants and lecturers should discuss current legal developments concerning commercial and corporate law in South Eastern Europe. In legal practice, these are topics of utmost relevance. Within the realm of these courses, participants should be enabled to critically question their own national legal systems and to effortlessly acquaint themselves with the national legal orders of South Eastern Europe. The module consists of 45 contact hours and awards 12 ECTScredits.

Requirements

In order to be admitted to the Master programme, applicants are required to hold a degree in law or in equivalent studies (Bakk. or Mag. or Dipl. or an equivalent degree from abroad) from a recognized post-secondary educational institution in Austria or from abroad.

Evidence of English language skills must be given, as English is the working language of the programme.
